A Hearing Panel may, on proof of service of the notice of hearing on the industry member under section 41(3), |

(a) |
proceed with the hearing in the absence of the industry member, or |
| |
(b) |
if the industry member initiated the appeal, dismiss or reschedule the hearing if the industry member does not attend the hearing. |
