Part 6 - General Section 83 - Administrative Penalties
83(1)
Where the executive director is of the opinion that a person
has contravened a provision of
(a)
this Act,
(b)
the regulations,
(c)
the bylaws, or
(d)
the rules
that is specified in the bylaws, the executive director may, subject
to the bylaws, by notice in writing given to that person, require that
person to pay to the Council an administrative penalty in the
amount set out in the notice for each day that the contravention
continues.
(2)
A person who pays an administrative penalty in respect of a
contravention may not be charged under this Act with an offence in
respect of that contravention.
(3)
Where a person fails to pay an administrative penalty in
accordance with a notice under subsection (1), the Council may
recover the amount owing in respect of the penalty in an action in
debt.
