Resolution 2006-5 of the Real Estate Council of Alberta

WHEREAS Section 12 of the Real Estate Act, confirms the Real Estate Council of Alberta (the “Council”) has the authority to make rules respecting the eligibility requirements for a person to acquire and retain an authorization.

Section 23 of the Real Estate Act Rules, states an industry member must satisfy all applicable continuing professional development requirements prescribed by Council to retain a licence issued to the industry member by the Real Estate Council of Alberta.

Council wishes to adopt a continuing professional development policy that prescribes the education requirements for all individuals who are industry members to retain a licence issued by the Real Estate Council of Alberta.

THEREFORE BE IT RESOLVED THAT:

Council hereby approves the following professional development policy for all industry members:
1. In this policy,
  (i) an industry member does not include a brokerage; and;
  (ii) “continuing professional development period” means the period from October 1st in any given year to September 30th the following year, unless specified otherwise by the executive director.
2. An industry member must satisfy the continuing professional development requirements approved by the Executive Director in each continuing professional development (“CPD”) period to retain the licence issued to the industry member by the Real Estate Council of Alberta.
3. Subject to the provisions in this policy, the executive director shall not issue a new authorization to an industry member who fails to satisfy the continuing education requirements applicable to the prior CPD period.
4. Satisfying the CPD requirements means the industry member must complete all the requirements that apply to the course(s) in question and may include classroom attendance, class participation, completion of assignments and passing any examinations.
5. An approved instructor of any CPD course who is an industry member is deemed to have successfully completed the CPD course in question for the purpose of this policy.
6. The executive director may exempt an industry member who successfully completes a pre-licensing program approved by the Real Estate Council of Alberta, and obtains an authorization in any given CPD period, from the CPD requirements in that year if the executive director is satisfied the pre-licensing program in question substantially addressed the same information covered by the mandatory course(s) for that CPD period.
7. When applying for a new authorization an industry member must, when requested by the executive director, submit proof the industry member has satisfied the continuing education requirements applicable to the prior CPD period within the time and form specified by the executive director.
8. The executive director may issue a new authorization to an industry member who is otherwise eligible for an authorization, but has not satisfied the CPD requirements of paragraph 2, upon the following terms and conditions:
  (a) the industry member makes a written application to the executive director;
  (b) the industry member pays a fee of $450.00;
  (c) the industry member agrees to complete any outstanding CPD requirements by a certain date and on the terms and conditions the executive director considers necessary.
9. When an industry member has received a conditional authorization pursuant to the provisions in paragraph 8 above and has failed to complete the outstanding CPD requirements by the date and on the terms and conditions the executive director considered necessary, the authorization of the industry member is immediately cancelled, unless the executive director extends the time to comply with the terms and conditions in question.
10. If an industry member has received a conditional authorization pursuant to paragraph 8, and the authorization of the industry member has been cancelled by the executive director pursuant to paragraph 9, any future application of the industry member will not be considered by the executive director until they have satisfied all their outstanding CPD requirements and have submitted proof, in the appropriate form, to the executive director.

This resolution replaces Resolution 2003-3.
