(1) |
Terms that are defined in the Real Estate Act and Rules have the same meaning when they are used in this Policy. |

(2) |
A person who wishes to obtain a real estate agent’s licence must fulfill the education requirements of the Real Estate Agents' Program and pass the Provincial Qualifying Examination for real estate agents. |
| |
|
|
| |
(3) |
To be eligible for entry into the Real Estate Agents’ Program, an individual must:
| (a) |
hold a High School Diploma in Canada, or an equivalency approved by the Executive Director; and, |
| (b) |
complete an industry overview course approved by the Executive Director and obtain a grade of 70% or higher. |

(4) |
The Executive Director shall have the responsibility for approving the course content, course outline, course objectives and lesson plans consisting of a set of topics and the amount of time allocated to each topic for the Real Estate Agents' Program. |

| |
(5) |
By Resolution dated July 9, 1996, the Council delegated to the Executive Director the responsibility for approving the Provincial Qualifying Examination for agents and the passing grade for this examination. |

|
| |
(6) |
The Executive Director may grant an exemption:
| (a) |
from the Real Estate Agents' Program and the Provincial Qualifying Examination in accordance with Section 5 of the Rules, or |
| (b) |
from the Real Estate Agents’ Program if, in the opinion of the Executive Director, a candidate has already taken an equivalent educational program. |

|
| |
(8) |
The Executive Director shall issue a Certificate of Completion to candidates who successfully complete the Real Estate Agents’ Program. |

|
|
| |
(9) |
The Real Estate Agents' Program may be taught through either a classroom delivery program or a distance delivery program (which may include a classroom component) approved by the Executive Director. |

|
|
| |
(10) |
To be eligible for a Certificate of Completion, candidates must attend at least 90% of the classes in the Real Estate Agents' Program or meet the attendance requirements of the education institution delivering this course, whichever is greater. |

|
|
| |
(11) |
To be eligible for a Certificate of Completion in the distance delivery program, candidates must complete all assignments in the Real Estate Agent's Program and obtain a grade of 70% or higher. |
| |
|
|
| |
(12) |
The Executive Director shall issue a Permission to Write the Provincial Qualifying Examination to candidates who have qualified for a Certificate of Completion for the Real Estate Agents' Program. |

|
|
| |
(13) |
Candidates must present their Permission to Write and an acceptable picture identification to obtain entrance to the Provincial Qualifying Examination. |
| |
|
|
| |
(14) |
| (a) |
Candidates who fail to obtain a passing grade on the Provincial Qualifying Examination may re-write this examination one more time upon payment of the prescribed fee. |
| (b) |
The Executive Director shall issue a Permission to Re-Write to candidates who wish to re-write and have paid the prescribed fee. |

| |
(15) |
A Permission to Write is valid for one year from the date of issue, and a Permission to Re‑Write is valid for sixty days from the date of issue. |
| |
|
|
| |
(16) |
Candidates who fail to obtain a grade of 70% or higher on the Provincial Qualifying Examination on two attempts are required to re-register and complete the course requirements of the Real Estate Agents' Program before they can re-write the Provincial Qualifying Examination again. |

|
| |
(17) |
Refund of course fees for failing to complete the Real Estate Agents' Program is at the discretion of the educational institution delivering this course. |
| |
|
|
| |
(18) |
The prescribed fee to re-write the Provincial Qualifying Examination is $50.00. |
| |
|
|
| |
(19) |
| (a) |
With an exemption from the Real Estate Agents' Program, the fee for writing the
Provincial Qualifying Examination and course materials is $300.00. |
| (b) |
With an exemption from the Real Estate Agent's Program and without course materials, the fee for writing the Provincial Qualifying Examination in $100.00., |

(20) |
This Resolution comes into effect on October 1, 2003, with the exception of clause 3(b) which comes into effect on October 1, 2004. |
