Resolution 96013 of the Real Estate Council of Alberta

WHEREAS by Rule 19(1) under the Real Estate Act, S.A. 1995, c. R-4.5 (the "Act" ), the Real Estate Council of Alberta (the "Council") may prescribe, adopt or approve

(a) educational requirements that must be met by an applicant for an authorization,
(b) the requirements for continuing education for industry members, including educational requirements that must be met prior to the issuance of a renewal of an authorization, and
(c) examinations for the purposes of Section 7.

THEREFORE BE IT RESOLVED THAT:

The Council hereby approves the policy for education and examination requirements for a real estate agent's licence.
1. Terms that are defined in the Real Estate Act and Rules have the same meaning when they are used in this Policy.
2. A person who wishes to obtain a licence as an agent must fulfill the education requirements of the Real Estate Agents' Licensing Program and pass a Provincial Qualifying Examination for agents.
3. The Real Estate Agents' Licensing Program shall consist of five compulsory courses and at least one elective course.
4. The Executive Director shall have the responsibility for prescribing the five compulsory courses and the various elective courses that constitute the Real Estate Agents' Licensing Program, including course outlines, course objectives and lesson plans consisting of a set of topics and the amount of time allocated to each topic.
5. By Resolution dated July 9, 1996, the Council delegated to the Executive Director the responsibility for approving the Provincial Qualifying Examination for agents.
6. The Executive Director may grant an exemption:
(a) from the Real Estate Agents' Licensing Program and the Provincial Qualifying Examination in accordance with Section 7 of the Rules, or
(b) from any or all of the courses for the Real Estate Agents' Licensing Program if, in the opinion of the Executive Director, a candidate has already taken an equivalent course or set of courses.
7. The Real Estate Agents' Licensing Program may be taught through either a classroom delivery program or a distance delivery program approved by the Executive Director.
8. The Executive Director shall issue a Certificate of Graduation to candidates who successfully complete the Real Estate Agents' Licensing Program.
9. (a) For classroom delivery programs, candidates must complete all course requirements of the Real Estate Agents' Licensing Program within two years from the date of registration for the first course.
(b) The Executive Director upon written application from a candidate may extend the time period to complete the course requirements for a classroom delivery program if, in the opinion of the Executive Director, the candidate's failure to complete the course requirements in the prescribed time was due to exceptional circumstances.
10. For classroom delivery programs, candidates must attend at least 75% of the classes and receive a passing grade of at least 70% on assignments and examinations for each of their courses in the Real Estate Agents' Licensing Program to be eligible for a Certificate of Graduation.
11. (a) For the distance delivery program, candidates must successfully complete all course requirements, including course assignments and examinations, within one year from the date of registration for the Real Estate Agents' Licensing Program.
(b) The Executive Director upon written application from a candidate may extend the time period to complete the course requirements for the distance delivery program if, in the opinion of the Executive Director, the candidate's failure to complete the course requirements in the prescribed time was due to exceptional circumstances.
12. (a) Candidates may register for the distance learning program at any time, but tutor support commences only four times a year for a period of six months.
(b) Candidates are required to complete their course assignments in the distance learning program during the six-month period of tutor support, but candidates may submit assignments for marking after the six-month period upon payment of the marking fee.
13. (a) For the distance delivery program, candidates must receive a passing grade of 70% of each course assignment and on each course examination to be eligible for a Certificate of Graduation.
(b) Candidates who fail to attain a passing grade of 70% on an assignment may re-submit a revised assignment for re-marking upon payment of the prescribed fee.
(c) Candidates who fail to attain a passing grade of 70% on a course examination may re-write this examination two more times upon payment of the prescribed fee.
(d) Candidates who fail to attain a passing grade of 70% in a course examination after three attempts are required to re-register and complete all course assignments for that course before they can re-write the course examination again.
14. (a) Candidates in the distance learning program must successfully complete the assignments in a course before they are entitled to write the examination for that course.
(b) The Executive Director shall issue a Permission to Write a course examination to candidates who have successfully completed the course assignments in that course or a Permission to Re-Write a course examination to candidates who have paid the prescribed fee.
(c) Candidates in the distance delivery program must make arrangements to write course examinations with the Executive Director.
15. The Executive Director shall issue a Permission to Write the Provincial Qualifying Examination for agents to candidates who have qualified for a Certificate of Graduation for the Real Estate Agents' Licensing Program.
16. Candidates must present their Permission to Write and an acceptable picture identification to obtain entrance to the Provincial Qualifying Examination for agents.
17. (a) Candidates who fail to attain a passing grade of at least 70% on the Provincial Qualifying Examination may re-write this examination two more times upon payment of the prescribed fee.
(b) The Executive Director shall issue a Permission to Re-Write to candidates who wish to re-write the Provincial Qualifying Examination and have paid the prescribed fee.
18. A Permission to Write is valid for two years from the date of issue, and a Permission to Re-Write is valid for sixty days from the date of issue.
19. Candidates who fail to attain a passing grade of at least 70% on the Provincial Qualifying Examination after three attempts are required to re-register in and complete all the course requirements of the Real Estate Agents' Licensing Program before they can re-write the Provincial Qualifying Examination again.
20. (a) Refund of course fees in a classroom delivery program for failing to complete the Real Estate Agents' Licensing Program is at the discretion of the education institution or real estate institution delivering this program.
(b) A candidate in the distance delivery program may have a refund of the program fees if the candidate returns all course materials in an unused condition to the course administrator before the submission of the first assignment or sixty days from the date of registration, whichever is earlier, but an administrative fee shall be deducted from the eligible refund.
21. In the distance delivery program, the prescribed fee for:
(a) taking the module of five compulsory courses and one elective course is $1,275.00, or
(b) taking one or more courses is $250.00 per course.
22. The prescribed fee for:
(a) marking a course assignment outside the six-month tutor period is $50.00;
(b) re-marking a course assignment is $50.00;
(c) re-writing a course examination is $50.00;
(d) re-writing the Provincial Qualifying Examination is $50.00;
(e) administering the refund of the program fee for the distance delivery program of the Real Estate Agents' Program is $50.00
23. (a) Every application for an exemption pursuant to paragraph 6 must be accompanied by an administrative fee of $50.00.
(b) With an exemption from one or more courses in the Real Estate Agents' Licensing Program, the fee for writing the Provincial Qualifying Examination and course materials is $100.00 per course.
(c) With an exemption from the Real Estate Agents' Licensing Program, the fee for writing the Provincial Qualifying Examination and course materials is $565.00.
